Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Bocard platform, including our website, mobile applications and related services (together, the "Services"), operated by Bocard Ltd ("we", "us" or "our"). By creating an account or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Services. By using the Services you represent that you meet these requirements and that the information you provide is accurate and complete.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• provide accurate, current and complete information and keep it up to date;
• maintain only one account unless we expressly permit otherwise;
• keep your password and any one-time codes private; and
• notify us immediately of any unauthorised use of your account.

3. Identity Verification (KYC)

To comply with applicable laws and to prevent fraud, we may require you to verify your identity before you can use certain features. This may include providing your full name, date of birth, a government-issued ID and other documentation. We may suspend, limit or decline transactions while verification is pending or if it cannot be completed.

4. The Services

Depending on availability in your region, the Services may let you buy and sell gift cards, trade supported digital assets and use virtual cards. Features are offered on an "as available" basis and may change, be added or be withdrawn at any time.

5. Rates, Quotes and Transactions

Rates and quotes shown are valid only at the time they are displayed and may change due to market conditions. The rate applied to a transaction is the rate confirmed at the time the transaction is submitted. Once a transaction is confirmed and processed it is, except where required by law, final and cannot be reversed. You are responsible for reviewing all details before confirming.

6. Wallet, Deposits and Withdrawals

Your account includes a wallet that reflects your available balance. Withdrawals are paid to the bank account or destination you provide, and you are responsible for ensuring those details are correct — we are not liable for funds sent to an incorrect destination you supplied. Minimum and maximum limits, fees and processing times may apply and may change from time to time.

7. Fees

Applicable fees, spreads and limits are displayed within the Services before you complete a transaction. By proceeding you agree to the fees shown for that transaction.

8. Prohibited Activities

You agree not to use the Services to:

• trade gift cards, funds or assets that are stolen, fraudulent or obtained unlawfully;
• engage in money laundering, terrorist financing or any other illegal activity;
• impersonate any person or provide false or misleading information;
• open multiple accounts to evade limits, bans or verification;
• use bots, scrapers or attempt to disrupt, attack or reverse-engineer the Services; or
• breach any applicable law or the rights of any third party.

We may report suspected unlawful activity to the relevant authorities and cooperate with any lawful investigation.

9. Digital Asset Risk Disclosure

Where the Services include trading of digital assets, you understand that the value of digital assets can be highly volatile, that transactions on public networks are generally irreversible, and that you trade at your own risk. We do not provide investment, financial, tax or legal advice, and nothing in the Services should be treated as such.

10. Suspension and Termination

We may suspend, restrict or close your account, and withhold or reverse transactions, if we reasonably believe you have breached these Terms, engaged in fraud or unlawful activity, or where required by law or a regulator. You may stop using the Services and request closure of your account at any time, subject to settlement of any pending transactions.

11. Intellectual Property

The Services, including all software, content, logos and trademarks, are owned by Bocard Ltd or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Services for their intended purpose. You may not copy, modify, distribute or create derivative works without our prior written consent.

12. Disclaimers and Limitation of Liability

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. To the maximum extent permitted by applicable law, Bocard Ltd will not be liable for any indirect, incidental, special or consequential losses, or for loss of profits, data or goodwill, arising from your use of the Services.

13. Indemnity

You agree to indemnify and hold Bocard Ltd harmless from any claims, losses or expenses (including reasonable legal fees) arising out of your use of the Services or your breach of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes we will take reasonable steps to notify you, for example within the app or by email. Your continued use of the Services after the changes take effect constitutes your acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the country in which Bocard Ltd is established, without regard to its conflict-of-law rules. Any disputes will be subject to the courts of that jurisdiction, except where applicable law gives you the right to bring proceedings elsewhere.
